Terms of Sale

These terms apply to every sale of software licences and monthly services made through the AINS AGENCY online store, to consumers and to business buyers alike.

A consumer is a person who buys for purposes outside their trade, business or profession. Any other buyer is a business buyer.

The buyer accepts these terms at checkout, before paying. The terms that apply are the version accepted at checkout, identified by the version date shown on this page.

A later version of these terms does not apply to an order already placed.

Software licences cover WordPress and WooCommerce plugins and code snippets. Each licence is sold for a number of sites or domains: one site, five sites, unlimited sites, or a named edition. Each licence includes one year of updates and support.

Licences are billed yearly as a subscription that renews automatically. The renewal price is lower than the first-year price (about 30% lower); each product page shows both prices for every tier.

Solutions are sold as a one-time setup fee plus a monthly maintenance subscription. The current solutions are E-Invoice Bridge and Call-Sync Bridge. The setup is scheduled with the buyer after payment.

Each product page states the number of sites included in each tier, so the buyer can choose the right tier before ordering.

Prices are shown on the store page in euros (EUR), or in US dollars (USD) for buyers outside the European Union. The price shown at checkout is the final price.

Payment is made by card or by the other methods offered at checkout. Stripe Payments Europe is the payment processor. AINS AGENCY never sees or stores card numbers.

An invoice is issued for each payment. The buyer sees the total amount before paying, and no other charge is added at checkout.

The contract is formed when payment is confirmed. Before paying, the buyer must check the product, the number of sites and the price.

The licence key and a time-limited download link are emailed right after payment is confirmed. The buyer must give an accurate email address, because the key and the links are sent only there.

The order summary shows the product, the number of sites, the price and the currency before payment. Once payment is confirmed, an order confirmation is sent to the buyer by email.

The buyer receives a non-exclusive, non-transferable right to use the software on the number of sites of the tier bought. The right does not allow resale or redistribution of the software, its code or its keys.

Activation is checked by the AINS AGENCY licence server, which verifies the domain and the software version. A key can be moved between sites by writing to contact@ains-agency.com.

The code remains the property of AINS AGENCY. The licence grants a right of use only.

Subscriptions renew automatically each year for licences and each month for solutions, until the buyer cancels. A reminder email is sent before each yearly renewal.

The buyer can cancel at any time from my account, which opens the Stripe customer portal. Cancellation takes effect at the end of the period already paid. No partial refund is given for the current period, except as set out in the Refunds section.

When a licence is not renewed, updates and support stop, and the licence may stop activating on new sites.

This section applies to consumers only. Business buyers have no right of withdrawal. A consumer can exercise the right by writing to contact@ains-agency.com.

As a rule, a consumer may withdraw within 14 days. For digital content supplied immediately, such as a licence key and a download, that right ends when delivery starts (article L221-28, 13°, of the French Consumer Code).

Before paying, the buyer ticks a box by which they expressly request immediate delivery and acknowledge that they lose the right of withdrawal. AINS AGENCY confirms this agreement in the order email.

For solutions, which are services, the 14-day right of withdrawal applies, unless the buyer asked for the service to start before the end of that period. In that case the buyer pays for the part already performed (article L221-25 of the French Consumer Code).

Beyond the rights set out by law, AINS AGENCY offers a commercial refund. If the software does not work as described on the buyer's site and AINS AGENCY cannot fix it, the buyer may ask for a refund within 14 days of the first purchase by writing to contact@ains-agency.com.

A refund revokes the licence.

If a buyer opens a chargeback or another payment dispute, the licence is suspended while the dispute is open.

Support is given by email at contact@ains-agency.com during the paid period. Requests are answered within 2 business days (Paris time), in English or French. Support covers questions about installation, activation and the use of the software as described on its product page.

The software is provided as described on its product page. AINS AGENCY is not liable for indirect damage, such as lost revenue or lost data.

For business buyers, the total liability of AINS AGENCY is capped at the amount paid by the buyer in the last 12 months.

Nothing in these terms limits liability that the law does not allow to be limited. Consumers keep the legal conformity guarantee for digital content, under articles L224-25-12 and following of the French Consumer Code.

AINS AGENCY processes personal data to deliver the order and the licence. This includes the email address, the billing address, the domain of the site and the IP address of each activation.

The legal notice page gives the full details. A buyer can write to contact@ains-agency.com to exercise their rights over this data, including a correction of any inaccurate data, within the limits set by law.

These terms are governed by French law. Before any dispute, the buyer is invited to write to contact@ains-agency.com so that the issue can be settled directly.

For business buyers, the courts of Paris have jurisdiction. Consumers keep the courts that the law gives them.
